SEC Includes Tokenisation and AI in 2027 Examination Priorities

The SEC's examination priorities for fiscal 2027 highlight tokenisation and advanced technology risks as key areas of supervisory focus. Tokenised securities are emerging in the US, but firms should not mistake this growth for a lack of oversight. The SEC's announcement on October 23 outlines that its examination staff will monitor tokenisation and emerging technologies, including AI and super intelligence, for their potential impacts on compliance, fraud, and market operations. This program covers advisers, funds, broker-dealers, clearing agencies, and other registered participants. While traditional issues like conflicts of interest and customer information custody remain relevant, the SEC acknowledges the evolving landscape of securities markets. The examination priorities serve as a risk-based agenda rather than a prohibition on tokenised products or an indication of rule violations by specific firms. Market participants exploring new custody models must demonstrate that their control environments are evolving in tandem with their financial technology.
